False Reimbursement Claims: Did you know that a medical device company will have to defend against allegations it misled doctors into purchasing medical devices for treating their patients by falsely claiming the service employing the devices was eligible for Medicare reimbursement? A federal district court for Maryland held that a doctor, representing a potential class of doctors, could continue litigation contending that Innovative Health Solutions knew or should have known that Medicare did not cover payments for acupuncture devices such as the “Neuro-Stim.”
