Section 1557:  Did you know that a federal court has issued a nationwide preliminary injunction preventing the federal Department of Health and Human Services (HHS) from enforcing the most controversial aspects of the new regulations implementing Section 1557 of the Affordable Care Act (ACA)? HHS may still enforce the parts of the regulation that prohibit most health care providers, as well as insurers and employers receiving financial help from the ACA, from discriminating against people based on race, disability, age and national origin.However, HHS may not, for the time being, enforce the parts of the regulation that relate to gender identity or termination of pregnancy.The trial court based the injunction on the court’s belief that HHS had exceeded its regulatory authority in adopting certain parts of the regulations.
