All Maryland Employers Must Register for New Paid Leave Program
All Maryland employers should begin preparing now for the launch of the state's Family and Medical Leave Insurance (FAMLI) program. While employee payroll deductions will begin on January 1, 2027, employers must first complete the required registration process with the Maryland Department of Labor (DOL).
What is FAMLI?
FAMLI is a state-administered paid leave benefit that will allow eligible employees to take up to 12 weeks of paid, job-protected leave to care for a new child, address their own serious health condition, care for a family member with a serious health condition, or manage certain military family needs. Payroll contributions begin January 1, 2027, and benefits become available January 1, 2028. Employees may receive up to $1,000 per week while on approved leave. About the program | Maryland FAMLI
Who Must Register?
Every employer with at least one employee working in Maryland must register with the FAMLI program. This requirement applies regardless of the employer's size or whether the company is headquartered in Maryland. There are no exceptions based on headcount. Employers with remote Maryland employees are also required to register. Ultimately, employers with less than 15 Maryland based employees will be required to deduct a contribution to the program from each employee, at a rate set by DOL, but not required to match that contribution. Employers with more than 15 employees will be required to both collect and match the contributions.
What Is Required Now?
Employers will need to create a FAMLI employer profile and designate an Authorized Officer—a person legally authorized to act on behalf of the organization. Registration is completed using the employer's federal Employer Identification Number (EIN), and only one registration is permitted per EIN. After confirming their identity, the Authorized Officer can authorize another individual to manage the FAMLI program on behalf of their company.
Later, this fall the State will provide template notices that employers will be required to share with employees.
