NLRB Postpones Implementation Of Notice Posting Requirement

In the face of continuing legal challenges, the National Labor Relations Board (NLRB) announced that it is again postponing implementation of its new employee rights notice rule until April 30, 2012. The rule will require all employers to post a notice of employee rights under the National Labor Relations Act. Previously, the NLRB's original implementation date of November 14, 2011 was postponed until January 31, 2012. We described the notice-posting requirement and legal challenges facing the new rule in two prior Employment Law Updates, one in October 2011 and one in August 2011.

In a press release issued on December 23, 2011, the NLRB stated that it had agreed to postpone the effective date of the notice-posting rule at the request of the federal court in Washington, D.C., which is hearing a legal challenge regarding the rule. The NLRB stated that the postponement "would facilitate the resolution of the legal challenges that have been filed with respect to the rule."
