I have been injured in a hit-and-run accident (or injured by a motorist who does not have insurance.) Do I have any recourse?

  • When injured by an “uninsured,’ driver, or a “phantom” vehicle, an injured party may need to make a claim or file a lawsuit against their own insurance company, thus creating an “adverse” relationship.
  • If your insurance company denies your claim, you may be forced to file a lawsuit against them for breach of the insurance contract.
  • When injured by an unknown or uninsured driver, do not provide a recorded statement to your insurance company without first consulting with an insurance litigation attorney as your statements may ultimately be used against you by your own carrier in resulting litigation.
