I am a HR executive who just received a letter from the Department of Labor or Internal Revenue Service indicating that my organization’s benefit plans are under investigation. What initial steps should I take?

  1. Don’t panic, but don’t ignore.
  2. Don’t respond before consulting with your legal counsel.  It is easy to fall for an investigator’s traps without proper guidance. 
  3. Work with counsel to determine which documents should be produced, and how to respond to questions. 
  4. Keep your service providers apprised of the investigation and involve them in correcting any noncompliance issues identified during the investigation
